This article is a review and reflection of the new elements of rights and laws, applied to the principle of justice and sovereignty, but above all in the demonstration that law as a science once again allows us to conceive that as a science it evolves and must be modified according to the new conducts that the State and society require, such is the case of the constitutional recognition that this type of rights have. In the last decades, human beings (...) have evidenced that the way in which they interact with nature is causing serious consequences to the ecosystems that compose it. In the past, these consequences were not yet evident and, therefore, the environmental awareness that exists today did not exist. Se han cumplido cincuenta años desde la publicación de Teoría de la Justicia. Sin duda, la obra de J. Rawls marcó un hito fundamental en la historia del pensamiento político del siglo XX. Nuestro trabajo se pregunta hasta qué punto la justicia como imparcialidad sigue siendo una referencia fundamental en el pensamiento político actual. Para ello abordamos la propuesta de M.C. Nussbaum. Nos planteamos si el enfoque de las capacidades de Nussbaum es realmente una continuación o supone una verdadera ruptura (...) con la propuesta de Rawls. Y a partir de las objeciones de Nussbaum a Rawls, nos interrogamos por el presente y el futuro de una obra que, a nuestro juicio, después de medio siglo, parece tener todos los ingredientes necesarios para ser verdaderamente un clásico del pensamiento político. Estudiamos varios conceptos clave en la obra del franciscano Fray Juan de Pineda, especialmente el concepto de ‘gracia justificante’, que se opone teológicamente a las ideas luteranas pero que desarrolla un pensamiento erasmista, afín a Fray Luis de Granada, a Francisco de Osuna y a Bartolomé de Las Casas. Estudiamos también su concepto de ‘lavacro’, procedente de San Pablo y su relación con la interpretación del Padre Nuestro, lo que apunta de lleno a la polémica doctrinal entre Carranza (...) y Melchor Cano. Finalmente hacemos ver la identidad de planteamientos erasmistas con el Lazarillo de Tormes, cuya geografía (Salamanca, Escalona, Maqueda y Almorox) coincide con el área de predicación de Fray Juan de Pineda a partir de 1544. Dada la coincidencia léxica, biográfica, doctrinal y de estilo entre el Lazarillo y la obra de Fray Juan de Pineda, sostenemos que esta novela picaresca corresponde a la intención reformadora del pensamiento erasmista franciscano del siglo XVI. Este trabajo trata de la importancia que tienen los estudiantes de medicina para responder a las demandas de atención médica en México; alude al proceso histórico que determina esta situación y la construcción de la categoría “médicos en formación”; refiere las condiciones laborales, educativas y de salud de los estudiantes de medicina en las unidades médicas, y su impacto sobre la calidad de la atención médica. Desde la perspectiva ética y de los derechos humanos se plantea que los programas de (...) educación médica, y en particular la categoría de “médicos en formación”, pueden, paradójicamente, violentar tanto el derecho a la educación como el derecho a la atención médica, y dañar tanto la salud de los estudiantes como la de la población por ellos atendida. Se concluye que debe desarrollarse un nuevo respaldo ético docente asistencial para educación médica en las unidades de atención médica. (shrink)

Being in a mood—such as an anxious, irritable, depressed, tranquil, or cheerful mood—tends to alter the way we react emotionally to the particular objects we encounter. But how, exactly, do moods alter the way we experience particular objects? Perceptualism, a popular approach to understanding affective experiences, holds that moods function like "colored lenses," altering the way we perceive the evaluative properties of the objects we encounter. In this essay, I offer a phenomenological analysis of the experience of being in a (...) mood that illustrates the limitations of the colored lens metaphor and demonstrates the basic inadequacy of the perceptualist account of moods. I argue that when we are in a mood, it is common to experience a kind of "emotional disconnection" in which we perceive evaluative properties that would normally elicit strong emotional reactions from us, but nonetheless we find that, in our present mood, we remain emotionally numb to these perceptions. Such experiences of "seeing but not feeling" are difficult to understand from within the perceptualist paradigm. Building on the work of Martin Heidegger, I sketch an alternative, phenomenological analysis of moods that can better account for experiences of emotional disconnection. On this alternative account, being in a mood does not merely alter the content of our perceptions but, rather, alters the way we interpret the overall significance of what we perceive, relative to a certain situational context. Recent ?dynamical? approaches to relativity by Harvey Brown and his colleagues have used John Bell's own solution to a problem in relativity which has in the past sometimes been called ?Bell's spaceships paradox?, in a central way. This paper examines solutions to this problem in greater detail and from a broader philosophical perspective than Brown et al. offer. It also analyses the well-known analogy between special relativity and classical thermodynamics. This analysis leads to the sceptical conclusion that Bell's solution yields (...) neither new philosophical insights concerning the foundations of relativity nor differential support for a specific view concerning the existence of space-time. In his logical papers, Leo Esakia studied corresponding ordered topological spaces and order-preserving mappings. Similar spaces and mappings appear in many other application areas such the analysis of causality in space-time. It is known that under reasonable conditions, both the topology and the original order relation $${\preccurlyeq}$$ can be uniquely reconstructed if we know the “interior” $${\prec}$$ of the order relation. It is also known that in some cases, we can uniquely reconstruct $${\prec}$$ (and hence, topology) from $${\preccurlyeq}$$. In this (...) paper, we show that, in general, under reasonable conditions, the open order $${\prec}$$ (and hence, the corresponding topology) can be uniquely determined from its closure $${\preccurlyeq}$$. According to relevance theory, irony comprehension invariably entails the identification of some opinion or thought and the identification of the speaker’s dissociative attitude. In this paper, it is argued that it is also essential for hearers to identify not only that propositional attitude, but also the affective attitude that the speaker holds towards the source of this echo so that an optimallyrelevant interpretive outcomeis achieved. This notion comprises feelings and emotions of a non-propositional quality which affect the propositional effects obtained (...) in ironical communication. This essay discusses Jorge Portilla’s phenomenological analysis of values and freedom in his essay, “The Phenomenology of Relajo.” Portilla argues that genuine freedom requires seriousness and sincerity; it requires wholehearted participation in cultural practices that one finds truly valuable. To support his argument, Portilla examines the ways that values and freedom are undermined when cultural practices are disrupted and break down as a result of the antics of the so-called "relajiento," a kind of “class clown” figure in Mexican culture who (...) refuses to take anything seriously. Carlos Sánchez has criticized Portilla's rejection of the relajiento, suggesting that the relajiento’s disruptive behavior may be a liberatory act of defiance against the legacy of colonialism. I argue, however, that Portilla was right to see the relajiento’s behavior as counterproductive in the fight for liberation from oppression. (shrink)

In the recently published 1924 course, Grundbegriffe der aristotelischen Philosophie, Martin Heidegger offers a detailed interpretation of Aristotle's definition of kinesis in the Physics. This interpretation identifies entelecheia with what is finished and present‐at‐an‐end and energeia with being‐at‐work toward this end. In arguing against this interpretation, the present paper attempts to show that Aristotle interpreted being from the perspective of praxis rather than poiesis and therefore did not identify it with static presence. The paper also challenges later variations of Heidegger's (...) interpretation, in particular his account of dunamis in the 1931 course on Metaphysics Theta, which insists that its mode of being is presence‐at‐hand. By arguing that this reading too is untenable, the paper concludes that Aristotle's metaphysics is not a metaphysics of presence and that his texts instead point toward a possibility of metaphysics ignored by the attempts of Heidegger and others to overcome it. En este artículo se expone una reflexión desde la propuesta teórica de Charles Taylor sobre la construcción de la identidad individual como una narración social frente a la crítica de Amartya Sen, quien propone la identidad como resultado solo de la elección personal. Se argumenta que las criticas que Amartya Sen hace a los argumentos de Taylor son infundadas, ya que la perspectiva de Charles Taylor se centra más en el carácter fundamentalmente constructivo, narrativo y dialógico de la identidad que (...) en la pérdida de la libertad y la mera aceptación acrítica de la identidad asumida. Se concluye que la identidad como narración social desde la perspectiva teoría de Taylor sí da cabida a la capacidad de elegir de los individuos y a la consideración de las identidades múltiples y múltiples lealtades identitarias, pero se hace notar la importacia del contexto social y del grupo por encima de la elección personal en el momento en que una persona contruye su identidad, ya que les da valor a los bienes externos como la comunidad cultural y lingüística a la que la pertenece y que hacen posible la inteligibilidad y la narracción de lo que somos y de quiénes somos. This paper presents Charles Taylor's theoretical proposal of construction of identity confronted to the criticism of Amartya Sen who conceives identity as a result of personal choice. It is argued that the critiques that Amartya Sen makes to the arguments of Taylor are groundless given that the perspective of Charles Taylor focuses more on the fundamentally constructive nature of identity than on the loss of freedom and the mere uncritical acceptance of the assumed identity. Taylor's theory does has space for the ability to choose and the consideration of multiple identities but it draws attention to the importance of social and group context when a person builds his identity and it assigns a higher value to the external goods that define the way people live in contemporary societies, such as the cultural and linguistic community, than to personal choice. The “destructive” appropriation of the Aristotelian concepts of δύναµις and ἐνέργεια played a central role in Martin Heidegger’s own reflection on the meaning of being. While this has been generally known for some time, it is only now that we can understand the full scope, complexity and evolving character of this appropriation. One reason is the fairly recent publication of notes and protocols for seminars Heidegger led on Aristotle as late as the 1940s and 1950s. Another is the existence of (...) student transcripts in the Special Collections Department of Stanford University for a number of unpublished seminars on Aristotle that Heidegger led during the 1920s. Considering all of this material enables us to see both the significance of Heidegger’s interpretation of the δύναµις/ἐνέργιεα pair as well as how this interpretation evolved along with his own “Kehre”: from a “pandynamic” conception of being to being as “Ereignis.”. During the 1920s Heidegger gave no less than twelve seminars and lecture courses devoted either exclusively or in large part to the reading of Aristotle's texts. Seven of these, especially the smaller seminars for advanced students, have not been published and apparently will never be included in the Gesamtausgabe. My focus here is on the very first of these. Billed as a reading of Aristotle's De Anima, much of it was devoted to Aristotle's Metaphysics. This decision not to separate Aristotle's (...) “psychology” from his “ontology” is a key move of the seminar that anticipates the project of Being and Time. This and many other ways in which Heidegger's early reading of De Anima anticipates the key moves of the later book constitute one of the reasons for its importance. Another is that the seminar allows us to see what gets suppressed in Heidegger's reading of Aristotle, most significantly, the phenomenon of life itself in favor of an eventual focus on the being of human life or Dasein. This early seminar thus enables us not only to better understand Heidegger's project, but also to raise some fundamental questions concerning it. (shrink)

Pendant l’ete de 1928 Heidegger a offert un seminaire sur le troisieme livre de la Physique d’Aristote et donc sur l’explication aristotelicienne de la nature du mouvement. La derniere seance de ce cours, qui eut lieu le 25 juillet, est d’une grande importance parce que c’est a cette occasion que Heidegger va au livre neuf de la Metaphysique pour essayer de comprendre la notion ontologique qui est a la base de l’interpretation aristotelicienne du mouvement : l’energeia. Mais dans les protocoles (...) de ce seminaire qui se trouvent parmi les papiers de Heidegger et qui ont ete publies recemment dans le volume 83 de la Gesamtausgabe, la seance du 25 juillet se trouve absente. Ce fait a conduit l’editeur a conclure que le seminaire avait pris fin le 23 juillet, sans s’apercevoir donc que la conclusion du seminaire manquait. Il existe heureusement une transcription preservee parmi les papiers de l’etudiante de Heidegger, Helene Weiss, et accessible aujourd’hui dans les archives de l’universite de Stanford. Cette transcription montre que la derniere session eut bien lieu le 25 juillet et nous offre la lecture heideggerienne de Metaphysique IX qui ne se trouve pas dans la version de la Gesamtausgabe. C’est dans le contexte de cette lecture que Heidegger fait la declaration etonnante qui nous concerne ici : ≪Dans la derniere instance, la Metaphysique Θ revient a Platon ; la priorite de l’energeia est fondamentalement la meme chose que l’epekeina des Idees. ≫La première tâche que je me propose ici sera d’expliquer cette déclaration qui suggère une relation tres etroite, ou meme une identite, entre la notion aristotelicienne de l’energeia comme ayant une priorite vis‑a‑vis de la dunamis et la notion platonicienne de l’Idee du Bien comme etant epekeina de l’ousia. Pour cette explication je ferai appel non seulement au contexte du seminaire de 1928, mais aussi aux textes plus tardifs comme les Beitrage et les cours sur Nietzsche dans lesquels Heidegger semble presupposer et développer sa déclaration de 1928. Ma seconde tâche sera de comparer cette thèse heideggerienne a la tentative de Gadamer de surmonter l’opposition traditionnelle entre les ontologies de Platon et d’Aristote en faisant appel a l’idee du bien chez les deux. Cette tentative se trouve dans le texte Die Idee des Guten zwischen Plato und Aristoteles. La comparaison que j’entreprends ici va montrer certaines affinites entre les interpretations de l’Idee du Bien chez Heidegger et Gadamer, mais aussi de profondes differences qui vont determiner leurs differents projets philosophiques. Heidegger’s recently published 1932 seminar on Plato’s Phaedrus arguably represents his most successful dialogue with Plato, where such dialogue is characterized by both the deepest affinity and the most incisive opposition. The central thesis of Heidegger’s interpretation is that the Phaedrus is not simply a logos about eros, but rather an attempt to show that eros is the very essence of logos and that logos is thereby in its very essence dia-logue. Heidegger is thus here more attuned than ever before (...) to the erotic and dialogical character of philosophy while at the same time concerned with how this conception of philosophy can lead to the eclipse of being and truth. This article tries to elucidate the Deleuzian project of the reversal of Platonism in relation to that of Nietzsche. To this aim, I have made a predominantly historiographic sketch of the question in both authors. In the case of Nietzsche, I inquired about both the relationship that the reversal of Platonism presents in his philosophy with the problem of nihilism and the evolution that the topic undergoes throughout his vast intellectual production, until it reaches its final formulation. With regard to (...) Deleuze, I offer a broad overview of his work aimed at tracing the subject, from his interpretation of the Nietzschean formulation, as opposed to that of Heidegger, to the meticulous way in which it fits into his own philosophy as a shift of the essence in favour of the event as a source of singularities. The present paper has a negative aim and a positive aim, both limited in the present context to a sketch or outline. The negative aim, today less controversial, is to show that Aristotle’s theory of final causality has little or nothing to do with the teleology rejected by modern science and that, therefore, far from having been rendered obsolete, it has yet to be fully understood. This aim will be met through the identification and brief discussion of some key points (...) on which Aristotle’s theory differs from teleology as still commonly understood. The positive aim is more controversial as it proposes that we take an ontology of life as the proper context for understanding the significance and nature of final causation in Aristotle. The argument for final causation, in other words, is that, without it, we would lose the phenomenon of life and, indeed, of nature altogether, reducing nature to the inanimate and mechanical. The theory of chemical symbiosis suggests that biological systems started with the collaboration of two polymeric molecules existing in early Earth: nucleic acids and peptides. Chemical symbiosis emerged when RNA-like nucleic acid polymers happened to fold into 3D structures capable to bind amino acids together, forming a proto peptidyl-transferase center. This folding catalyzed the formation of quasi-random small peptides, some of them capable to bind this ribozyme structure back and starting to form an initial layer that would produce the larger (...) subunit of the ribosome by accretion. TCS suggests that there is no chicken-and-egg problem into the emergence of biological systems as RNAs and peptides were of equal importance to the origin of life. Life has initially emerged when these two macromolecules started to interact in molecular symbiosis. Further, we suggest that life evolved into progenotes and cells due to the emergence of new layers of symbiosis. Mutualism is the strongest force in biology, capable to create novelties by emergent principles; on which the whole is bigger than the sum of the parts. TCS aims to apply the Margulian view of biology into the origins of life field. (shrink)

Unemployment is not only an economic problem, but a complex axiological one, the understanding of which cannot be envisaged without dealing with all the social, economic, political and institutional causes. Unemploy ment in Spain is so high (18% of Active Population). That its solution needs other ways out than those sustained by traditional economicist approaches based mainly on neoliberal economic growth. To be more specific, Spain suffers from three axiological desequilibria (more unemployment, less public services and infraestructures, and less tax (...) preasure) which adequate integrationand optimization could solve, not the problem wholely, but at least, by bringing Spain into line with the European rate.
